Manifesto

No dia 9 de Setembro de 2009, Portugal tomou conhecimento, através da comunicação social, de uma ocorrência gravíssima neste país que tanto lutou pela Democracia: um acto de censura contra um livro.

O livro “Maddie: A Verdade da Mentira” foi sujeito a uma providência cautelar que visou, não apenas a suspensão da venda do livro e do DVD baseado na obra, mas também de toda e qualquer divulgação da tese veiculada pelo Dr. Gonçalo Amaral, autor do livro e ex-coordenador da Polícia Judiciária, sobre o caso ‘Madeleine McCann’.

Com este acto, bania-se não apenas a obra escrita, mas todo um pensamento: a expressão de uma opinião, baseada em factos de uma investigação policial; uma conclusão racional, responsável e adulta.

No entanto, tal providência cautelar era apenas a ponta de um icebergue. Na acção principal a que se refere, os pais de Madeleine visam extorquir ao Dr. Gonçalo Amaral a soma de 1.2 milhões de euros – um valor astronómico e fora de qualquer proporção, seja legal, seja ético.

Uma segunda providência cautelar viria ainda apreender bens e vencimentos ao requerido, manietando a sua capacidade de resposta em termos financeiros, uma vez que as custas judiciais e de processo se encontram indexadas ao valor exigido na acção principal. Desta forma, sem capacidade de livre expressão e economicamente asfixiado, completa-se o cerco a um Homem que tem procurado, com elevado custo pessoal e familiar, única e exclusivamente a reabertura de um processo judicial, para que se possa concluir uma investigação que muitos consideram ter ficado aquém das suas potencialidades.

O Dr. Gonçalo Amaral não pode falar. Mas nós, Cidadãos Portugueses, podemos falar por ele.

Podemos falar, e podemos agir.

Agir na defesa da liberdade de expressão, direito constitucional que entendemos inalienável, sobretudo quando é exercido de forma responsável e madura.

Agir no apoio a quem se vê privado de meios para se defender legalmente, na sequência de manobras deliberadas por parte de quem visa a sua destruição, pessoal e profissional.

Agir porque hoje a vítima da mordaça da censura é o Dr. Gonçalo Amaral – amanhã poderá ser qualquer um de nós.

Este Projecto visa a acção e o apoio a quem procura Justiça. Os Cidadãos que dão início a este movimento, associam-se de forma livre, independente e apolítica, unidos na defesa da liberdade de expressão e no respeito mútuo.

A nossa primeira acção é o lançamento de uma petição; outras iniciativas se seguirão.

Manifesto

On the 9th of September, 2009, Portugal and the World learned, through the media, about an extremely serious occurrence in this country that fought so hard for Democracy: an act of censorship against a book.

The book “Maddie: A Verdade da Mentira” was subject to an injunction that sought not only the suspension of sales of the book and the DVD that was based on it, but also of any and all divulgation of the thesis that is defended by Dr. Gonçalo Amaral, author of the book and former Judiciary Police coordinator, about the ‘Madeleine McCann’ case.

Through this action, a ban was imposed not merely on the written work, but on an entire line of thought: the expression of an opinion, based on the facts of a police investigation; a rational, responsible, mature decision.

Nonetheless, said injunction was merely the tip of an iceberg. In the main action that it refers to, Madeleine’s parents seek to extort the sum of 1.2 million Euros from Dr. Gonçalo Amaral – an astronomical amount that is out of any proportion, both legal, and ethical.

A second injunction succeeded in apprehending belongings and professional income from the defendant, stifling his capacity to respond in financial terms, given the fact that judicial and process costs are indexed to the value that is demanded through the main action. In this manner, stripped of his freedom of expression and economically asphyxiated, the siege on a Man who, at huge personal and family cost, seeks nothing more than the reopening of a judicial process, in order to conclude an investigation that so many consider has been cut off halfway through, closes in.

Dr. Gonçalo Amaral cannot speak. But we, Citizens of the World, can speak for him.

We can speak, and we can act.

We can act to defend freedom of expression, a constitutional right that we see as inalienable, mainly when it is exercised in a responsible, mature manner.

We can act to support a Man who is deprived of the means to legally defend himself, following deliberate manoeuvres from those who seek his personal and professional destruction.

We can act because today, the victim of censorship’s gag is Dr. Gonçalo Amaral – tomorrow it can be any one of us.

This Project seeks action and support for a Man who wants Justice. The Citizens that initiate this movement associate in a free, independent and apolitical form, united in the defence of freedom of expression, and in mutual respect.

Our first action is the launch of a petition; other initiatives will follow.

For the exercise of free, firm and responsible citizenship, we will not be silenced.

ps: os jornalistas, en geral neste caso , ajudam a censura . Onde esta a liberdade dos jornalistas ?

Não há nada mais sagrado do que a Liberdade, sem dúvida.
Aqui a liberdade pode se condicionada, mas lá a coisa é realmente patética. Nunca pensei que tal fosse possível.

I will certainly be signing and making a pertinent comment because this man has been hounded by everyone who is trying to hush up the disappearance of a child of 3 -Madeleine McCann.

And everyone who believes in the freedom of speech should sign this petition for Goncalo.

The McCanns get plenty of air time and opportunity to say what they want, but there seems to be one rule for them and another for everyone else!

Following the release of the video, the comments from the UK police & newpaper reports, I have taken the trouble to read a lot this week. It is clear that as far as the UK is concerned there is only one version of this story, the McCanns.

It is also clear that many things do not stack up. Mitchell said there were innocent explanations to things the police had found. Although I do not agree with trial by media, IMO Gerry wasted a big opportunity to set the records straight when interviewed by the Portuguese reporter. But, in his usual arrogance manner said "ask the dogs" and you know the rest.

This couple expect the world to support them in their quest, and their supporters expect anti's to show compassion and sympathy because they are convinced the McCanns are totally innocent and genuine caring people.

I don't know if they are innocent or not, but they are certainly not caring people. It is time a line was drawn under all of this and they should respect the fact that due to their weird behaviour when Madeleine went missing and their lack of co-operation etc, it was they who allowed the doubt to remain. If they had met with Mr. Amaral and answered his doubts, maybe he would not have had the need to write the book, and in turn they would not be in a position to sue.

They should just get on with what they claim is all they want "find madeline" and drop all this other publicity seeking and other peoples life destroying nonsense.

Let's face it, if Mr. Amaral is correct in his assumptions but has not enough evidence to bring charges, then he will be tormented by that for the rest of his life.

If the McCann's are right and they get a breakthrough then everyone will know how distressing it must be to be accused of something you have not done.

Either way, the police should do what needs to be done, and the McCanns should do what they want to do but accept now that they have had more than their fair share of publicity.

IMO it is time for a pact of silence from the UK media - If they cannot report both sides of the story they should report nothing. They should stop dragging innocent people onto the front pages everytime the Madeleine saga goes quiet.

I have not been a follower of Tony Bennett, but heaven knows what is going on with TB and Butler. One minute they are leafleting Rothley and the next they seem to be on opposing sides.

What an unbelievable case this has been, blog wars, conspiracy theories, pacts of silence, accusations of tapas member being a paedo, sightings of gerry carrying madeleine etc etc etc and more than two years on, no further ahead than day one!!

Wake up all - I finished!!!!!

BTW Claudia, I should have said in the long post of mine that I am totally in favour of freedom of speech and I feel the UK papers idea of that are one sided.

To be honest, I couldn't agree more with you.
This blog wouldn't even exist if the McCanns had properly cooperated with the authorities. Even if I didn't believe what they said was true. If the Police had had their cooperation and access to all the information asked and then still haven't found anything, I wouldn't be here because sadly some cases are never solved and that happens everywhere in the world. What I can't accept is that the parents of the missing child are the first ones not to help the authorities which are looking for a child whose life (if you believe her parents) is in danger. That I can never accept.

The McCann's opinions would be a lot more believable if while 'leaving no stone unturned' in their search for Madeleine, they offered a huge reward for her safe, or otherwise, return. Even if Madeleine's body was found, at least they could give their daughter a decent burial and get on with their lives. But not a word about a reward on their recent video. How strange is that?

Exactly, also because of this people will naturally question why they did not choose to co-operate. So at the end of the day they have nobody else to blame but themselves for all opinions and comments about them. To leave children unattended, night after night, in a unlocked room (especially one who sleepwalks) is totally irresponsible and selfish but even to this day they see no wrong in that. Now they are allowing the twins to talk of "fighting the bad man who took their sister". Unbloodybelievable!!

the truth is, had they fully cooperated, this case would have been forgotten by now. How many missing children are there? Hundreds? Thousands? of course, none of these children's parents speak with Prime Ministers on the pone, go see the Pope and are able to decide when and how they decide to cooperate 8or not) with the proper authorities.

I just read on Joana's blog that in her latest interview (not with the McCanns) she doesn't rule out the abduction scenario. A bit disappointing to say the least, after her recent interview with them when she posed some really difficult questions. Let's hope she hasn't been convinced by them. Maybe she has in mind the title of Stevo's book to be published - "Faked Abduction"!

I haven't been online much and I haven't read anything but I am not disappointed because of that. At all. She is a journalist. Her personal opinions aren't really relevant. She just has to do her job which was what she did. And she is still the only journalist who has asked them difficult questions. Moreover, most people can't 100% rule out abduction even if there is no evidence whatsoever that that was what happened. And, of course, let's not even mention the parents' reactions.
I bet that many British journalist don't believe their version of facts. But they are still too coward to ask them serious questions. Sandra did that. Whatever she thinks as a citizen doesn't concern me. As long as her job isn't affected by her prejudices. :-)

Madeleine can only really be missing possibly in the hands of a peadophile ring if Gerry and Kate McCann are the most evil parents in the history of the world....

No parent would spin the truth if there was the slightest chance they could find their child alive...

Yet for all their bluster they have never co operated with the PJ have only allowed their version of events to be given and the last thing on their agenda is helping Madeleine if it was the first thing they would be pushing would be the reward....

Kate McCann must be evil through and through to refuse to answer questions and I say this because if Madeleine was missing her lack of help makes her look guilty and she cant afford for anyone to think this as they will stop searching for Madeleine....

To trust their friends is a joke lets look at it this way Jane Tanner is the only person to have seen the "Abductor" yet Gerry and Jez did not see Jane which means she is lying... Her husband is missing for most of the meal and the McCann's trust these people???

Nothing they have done is normal but trusting their friends without question is the strangest of all...

Everyone else is to blame for what happend to Madeleine and they are happiest when people are fawning over them...

Well sorry Team McCann but your heroes neglected their children for a night in a bar and their Mother on realising and knowing as a fact Madeleine had not wandered off and an evil peadophile had taken her left the twins alone once more while walking a long way back to the bar to tell everyone what she had discovered....

I swear to god if Madeleine really was abducted my feelings towards the McCann's will be of total discust. I dont like them now but if she died in an accident I guess it is self presvation. If she really is missing then may they suffer the same fate as they left their daughter to...

I swear 2.5 years later all the proof that Madeleine was not taken is there for the world to see by the McCann's own actions...

No parent would play the games they have with their childs life if there was any chance of finding her alive...

Not sure why Madeleine is not important? then we live in a country where a young boy can be tortured to death by his Mother her partner and her partners brother over months and agonising months and even a Dr says a broken back is a cold and he is sent back to the Monsters who broke it...

Never mind hey they got a few years in jail and on their release will get a new identity and be protected more than the child ever was at a cost of millions that should go towards child protection...

The McCann's love to sue if Madeleine is still alive and as her father is hopeful she will return on day way into the future, they may be surprised that once she has viewed their campaign and looked at her fund that was squandered on wages lawyers and spin dr's and a throw away amount spent searching she takes them for every penny they have....

Petition signed. Poor GA. What did he ever do to deserve this? His life has been made a living nightmare by this case and it's destroyed him. I really hope he is coping...

We should not accept this gagging of a book, ffs - it's a book!! We should not accept this censorship in our times and within a supposed democracy. The public have a right to chose what they wish to read, and if this book is banned - what next?? Cookbooks with pork recipes in case certain religions find it offensive?

The McCanns truly disgust me. Their behaviour has been a disgrace. I hope there is truth to the notion of Karma...

Hi Claudia,

It seems one of my posts went missing.

I wrote that a woman who had killed a child while baby sitting has been given a plane ticket back to her country by the government together with a £4,500 cheque! Let's hope she doesn't use part of it for a plane ticket back and murder some other child.

And the tax payers foot the bill as usual. And they say that crime doesn't pay!
