Prison visits

Cipriano Case: PJ Inspectors Accused at Faro Trial

The collective of judges considered that Leonor Cipriano was tortured, even though it could not be proved by whom. In the verdict read today, two PJ inspectors were accused, Nunes Cardoso to document forgery and Gonçalo Amaral to omission of denunciation of the aggressions suffered by Leonor Cipriano, the rest of the 5 arguidos [defendants] were absolved.

Gonçalo Amaral was sentenced to one year and an half of jail. The two PJ inspectors face a suspended sentence.

The lawyers for Cipriano, Marcos Aragão Correia and the assistant representing the Bar Rodrigo Santiago will appeal as well as António Cabrita, Gonçalo Amaral's lawyer.

Well the verdict does not change the fact that Amaral is on the side of neglected and murdered children...

I would rather defend this man than defend and worship child killers like Leonor or liar's and child neglectors like the McCann's...

I am not a violent person and do not belive in torture but with all the story's comming out of the abuse of children like Baby Peter my attitude is changing and if someone wants to dish out half of what the 3 people who killed Baby Peter inflicted on them I wont loose any sleep...

And any Mother who has a missing child and lies and laughs about it I think I would find hard not to slap some sense into them...

I hope the apeal revokes this if not I still have respect for Amaral and none for the McCann's...

After all from what I have read it dosent look like they think he did anything wrong anyway????

I obviously condemn violence. When it happens.
There are at least two appeals possible (if I remember correctly). At least that was what happened in Leonor Cipriano's case. She lost them all and only after that could she be called a convicted child killer. Everybody knew that whatever the outcome of today, there would always be appeals from one or both parties, because certainly one (if not two) parties wouldn't be satisfied with the result. I heard that all parties are appealing.

I am against violence as well but, in this case , as Soda says i didn´t loose my sleep concerning LC.I don't know who beat LC and I am not upset about it; what astonish me is all the noise made surrounding this case,mainly the position of Lawyer's Order and the credibility of the so called lawyer AC.Also i put my doubts on trials with jury.
I hope GA and his colleague appeal and won .

Don't worry. Mr Marinho e Pinto seems to have enough problems going on at the moment. Being the Head of the Lawyer's Bar and having all lawyers against you, can't be an easy job.
Yes, I heard all parties are going to appeal (which was expected no matter the outcome) and Mr Amaral confirmed it as soon as he was leaving the court.
Got to go correct essays.

Absolutely stunned to hear that Goncalo Amaral has a suspended sentence, but glad that he came out of that courtroom determined to appeal against his unfair sentence.

The mother and uncle of Joana deserved all they got, if indeed they were beaten up. What about poor defenceless little Joana who has had her life taken from her at such an early age.

They should concentrate on the perpetrators of these horrendous crimes against children instead of crucifying police officers who have to deal with this sort of thing day in day out. Who could blame them for beating up someone who so cruelly used a child.

Rough justice it may be, but sometimes the law is a real ass.

You don't walk alone Goncalo! Many people are on your side, including your lovely family.

Sofia Leal and Goncalo Amaral will always have my 100% support and 100% respect. Imo the Law is an ass however I do believe Justice can prevail! I have no respect for people who put themselves before their children's safety. Parents are duty bound to protect their children. There are no excuses for being neglectful! If those imo selfish ignorant parents had used the free crèche that was available or paid for a babysitter then hopefully MBM would (unless she mysteriously disappeared on another holiday due to poor parenting, imo) still be living with her family in Rothley, living her usual life, whatever that may have been for her. Sadly that is not the case. Sadly so many people have suffered due to this couple and by their "well within the bounds of responsible parenting style". Sadly GA was removed from the investigation of this missing child imo because he would not compromise his morals. Why should he? People with integrity do not do that. GA, as far as I am aware, was a very experienced dedicated Senior Police Officer who is very well educated therefore very intelligent. GA would still have been serving in the PJ and dealing with the Cipriano situation, we would never have heard of him or little Joana Cipriano and her demise. Sadly he chose to retire from his profession. He was not sacked, he was not disgraced as some like to portray and no doubt they will be dining out in their own back garden milking today’s news to the nth degree, twisting it like their Mockumentary twisted things their way! Perhaps that is what these people will class as something positive in their search! Perhaps that is the reason for the smirking that was displayed on the 18/05/09 when asked by a This Morning presenter about suing GA! I personally as a viewer of This Morning could not understand why this man who was there because his child is missing could look like that on national TV! It was imo almost another lottery win look-a-like pic! He smirks like that whilst the people of PdL have had their lives disrupted because he was at the Tapas Bar with his wife night after night whilst their children were left in the holiday flat unsupervised! The people of PdL should be living their lives and the name McCann should mean nothing to them. The people who have been selected from the files and imo implied by the McC's as suspects that were overlooked by the bungling PJ (who incidentally ruled them out) were allegedly found by K who spends 3 hours a day forensically checking the files whilst she sips her tea would not have had their lives disrupted either imo by a selfish pair who choose to blame everyone and their Granny, except themselves, for whatever situation that M may or may not be in. The list of people who have suffered due to these imo disgraced parents could go on and on! I have faith in GA, faith that he will find justice for a poor child who mysteriously vanished into thin air without a trace whilst on her family holiday in May 2007!

In fact, I don't think those two convicted child killers got all they deserved. They deserved to get a life sentence but sadly there's no such thing here.
Appeals were expected whatever the outcome. If the arguidos had all been cleared, the prosecution would appeal. If the arguidos had all been convicted, the defense would appeal. If some were cleared and others convicted, both parties would probably appeal. I think this will only end with a Supreme Court's decision, which is common.

"We have made contact with the German authorities. We are just waiting for clearance so we can actually go and speak to him regarding that incident," said a spokeswoman. "We cannot go into details on the incident."

Two retired UK detectives hired by Madeleine's parents to search for their daughter hope to interview Hewlett with the help of British police.

A source said: "A proper police force such as West Yorkshire may get first crack. It's then a question of us liaising with the police to see what access we can get."

But the source added: "He is one of a number of possible leads that we are looking at. We are not going to give it any more weight than that. We are being quite cautious on this."

Leicestershire Police, which handled the British end of the inquiry into what happened to Madeleine, refused to comment.

Nancy, Zodiac, I am shocked by what you say. This has nothing to do with the McCanns' guilt or innocence.

I'm sorry, I cannot condone violence or torture agains ANY prisoner, even low life like the Ciprianos, even in matters of national security. It isn't a case of someone deserving it or not, it is a matter of civilised behaviour.

The fact that there were legal proceedings againt members of the PJ and that the court apparently acted without fear or favour reflects great credit on Portugal and its democracy.

I am sure they will. They don't need much of an excuse to blacken GA's character, which just goes to show that they are very worried about him. I see lots of gloating on the horizon - yuck! I am sure K & G will see this as a major victory, although quite what this has to do with finding their daughter, I don't know.

I'm sorry that you were shocked because I thought the Ciprianos deserved everything they got.

Those two monsters will still be seeing a new dawn, but what will little Joana see?

Parents who ill treat their children don't deserve any sympathy and I can quite understand if a policeman loses his cool and resorts to violence when confronted with monsters who have murdered a child.

I'm afraid my tears are for the child victims not for those barbarians who killed her.

So I stand by what I said!

I agree that Goncalo Amaral is certainly not and never has been a 'disgraced' PJ. He has done nothing to warrant that label, but simply wanted to find out the whole truth about what happened to Joana (and Madeleine of course) with nothing but hindrance from those involved all along.

None of the newspapers here said how disgraceful the Ciprianos had acted in killing their children, but instead saved their venom for Goncalo Amaral.

Typical of our media of course.

I'm a bit upset, just found our hamster died. I went to give her enough food and water for the weekend before I left and she's lying on her side, not moving. I called her (but knew it was fruitless). She looks as though she has just fallen asleep on her side. She was two years and 3 months so I guess she was old in hamster terms.

I've called Laura and Elly and told them. They seem to be remarkably OK with the news. We knew she wouldn't last as she had a stroke 2 weeks ago. Maybe I'm just upset because I found her like it. It was a bit of a shock. Bless her, I'll miss her furry, twitchy nose and seeing her paws up against the cage when she heard our voices.

Silly really, how such a small rodent can instill such love & I don't understand why I'm so upset. I'm just glad that the girs didn't find her like that and I did. I'll get over it. We are going to make a box for her and put in bits of paper with all of the things that we loved about her. Why do I always have to be alone when I make grim discoveries? I suppose it's better this way than Elly finding her like that when she comes home on Tuesday, on her birthday. At least now, she knows and is prepared.

I was shocked by the fact that you find nothing wrong with beating up and torturing someone in custody. And giving 100% support to someone who concealed that it had happened.

It is fundamental to a civilised way of life that ALL suspects have the right not to be assaulted, whoever they are and whatever they have done. Both the UK and Portugal support this principle. in fact the authorities in our country refuse to deport ANYONE to a country where torture is likely.

Criticism of Snr Amaral obviously does not mean that he or his colleagues are worse than the criminals involved -- one just expects better of the police. Democracy, as Claudia knows, is a fragile structure and torture should not ever be part of it.

I am surprised that you ask.

And when I said this had nothing to dc with the McCanns, Claudia, I meant that my support for this principle has nothing to do with them. Sorry -- that wasn't clear.

So sorry about your pet Dylan -- and your friend Claudia. I hope she recovers quickly.

I agree with you regarding torture and I have said so. But when it really happens, which I don't believe is the case here. After all the appeals, we'll see. By the way, the 'acordão' (which is the whole of the verdict yn writing) may be available soon online (not sure about that). When it is, I am pretty sure it will be a source of a lot of work. It's a feeling. :-)

It's not a friend of mine. I know the girl because she'a a student oa a colleague of mine. She's very nice and was indeed lucky. She was hit by a stupid driver while she was in the middle of the zebra crossing. She'll be spending the night in hospital for precaution (she hit her head), but she'll probably be home tomorrow morning. Broken bones, though. I broke my right arm once and know how much inconvenience it brings. Can't imagine an arm AND a leg!

JennyH where in my post have I said I support the beating and torturing of someone in custody? Please copy and paste those words because I cannot see them in my post.

I said that I give my 100% support to Sofia and Goncalo. Sofia did not beat or torture anyone, or conceal it . My 100% support for Goncalo is because I actually believe this man is doing something for the missing child. I said the Law is an ass and Justice can prevail, because two police officers received suspended sentences whilst 3 other officers are exonerated. Therefore the two officers who received the suspended sentences received them for not reporting something that did not happen and the 3 officers accused are exonerated. Where is the sense in that? I also believe justice can prevail because this case has nothing to do with the MBM case. Although I do believe that certain people desperately try to associate this case to M's for their own agendas and will milk and twist this to the nth degree in the McPress/Media. Look at all the twisted articles thus far with the Pink slops all over them!

Zodiac, I only took issue with your 100% support in view of the fact that Snr Amaral has been found guilty by a Portuguese court of falsification. If this is overturned on appeal, that is different. Maybe it will be.

It was Nancy who believes that the assault is 'understandable' and stands by what she says. The problem with that is that there is no way you can draw a line and say 'if the criminal is bad to X extent it is OK to give her a slap, and if worse, a punch, and if really wicked, then beat her up'. The police cannot take matters into their own hands and the Portuguese courts uphold that, as ours do.

I also wondered how the three policemen could be found not guilty and the other two officers guilty! I can only assume that the court could not be sure WHICH of them had assaulted Cipriano, but WERE sure who had falsified the documents. But this is just a guess -- could be wrong.

I hope they get the person who knocked down the student, Claudia. I never assume I'm safe on a pedestrian crossing.

No, the court found those 3 arguidos innocent. In fact, Leonor Cipriano (long before trial) had the opportunity to identify her 'aggressors' (she was put behind one of those miracle glasses/mirors and looked at all the PJ officers who had been working that day) and failled to recognise any of them. She suddenly remembered in the middle of the trial and wrote some names in a piece of paper which the judge, obviously, ignored and mentioned in the verdict. The reason why the 3 were cleared and the other two were convicted will probably be the basis of the appeal (and I know very little about the laaw), according to what I heard a law specialist say on TV yesterday.
Mr Amaral was not convicted of falsification. Mr Amaral was convicted because 5 months after whatever happened he maintained that he knew nothing about it. The court understood that he was lying. That was why he was convicted. Interesting that Mr Amaral was cleared of the charge of failing to denounce the 'torture'... (this will be importante in the future too). Mr Cardoso was convicted of falsification.

The guy who was driving the car didn't run away. He stayed there, helped the girl, called the ambulance etc. He was quite in shock, from what I heard and was just repeating 'I didn't see her, I didn't see her'. He was in the hospital with the girl and everything. At least that. The girl even told him not to worry because she was fine! :-) The gir's younger sister (who is 7) found her older sister's plasters very funny! :-)

Whether it is or not my support will still be 100%. As I said before the Law is an ass. Imo GA is MBM's only hope for justice.

I am so glad this girl is ok. Also that the driver did not take off. When I was young (about 7) my sister (12) and I were at a crossing, we were just about to cross when a car drove right up onto the pavement where we were standing (I was totally oblivious to all of this) my sister grabbed me and pulled me to the side then lay on top of me to protect me. Fortunately the car swerved to the other side. She saved both our lives that day, she also put herself in danger to protect me. Due to my age I did not appreciate fully what Dee did that day and it was only when I was older I understood her bravery.

Claudia next time I have to pinch OH's laptop I think I will put it in the freezer to cool down then I will take it out to defrost and he will be none the wiser! He said again how brilliant Lie to Me is. When he discovers his laptop his not working I will just take deep breaths, blink quickly, then shrug one of my shoulders twice, close my eyes and keep them closed as if I am thinking about what I am going to say then look straight at him and say it has n..n..nothing to..to..to. do..er.w..w..with me!

I do believe that sometimes the police are driven to distraction by trying to get to the truth and can lose their cool. They sometimes have a mammoth task on their hands, as did the PJ's in the Madeleine case.

When you have a mother whose child has gone missing and she refuses to answer 48 questions to help her child, can you imagine how difficult that is for the police who are questioning her. Then they get called disgusting names in the media for not doing enough!

I still say the law is an ass in many respects, and having worked in it for fifty odd years I have seen enough idiotic verdicts to write a book.

It was a complete and utter tragedy that Goncalo Amaral was dropped from the Madeleine investigation and I'm sure most of us would agree with that - apart from those on the Rosiepops blog of course, who are libelling Goncalo Amaral disgracefully. What a rat infested hole that is.

Anyway, we can't all agree all the time Jenny. That would be boring wouldn't it?

Front page news on the DX and it's also been on Sky, that Maddie could have been taken to a million pound mansion nearby. Possibly wanted a pretty blonde girl to add to his family. I bet she's giving them her tuppance worth!!

You couldn't make it up could you. Just what is going on at the moment - everyone in the world seemed to have their eye on Madeleine and the apartment in PdeL.

At least it's a change from the MP's and their fiddlings!!

Have you heard the latest from the Pink one? Clarrie is now telling the Paedo in Germany to see sense and cooperate with the McCanns detectives, how transparent is he?
I think they will attempt to bribe him, offer him money for his family to confess ...I only hope they don't succeed. I really can't believe that the British public are so naive, a lot of people were saying in my work on friday that he looked like the photofit. There have been so many how can they possibly believe in anything Team McCann come up with is a mystery to me. But our press are so useless, they print such baised reports I suppose if thats all the information you get you will be inclined to believe it.I only hope that The Trugth of the Lie is published in English, I will buy some for friends and family.

Sadly, they are turning a tragedy into a comedy. Most people are now making jokes about the 'suspects', which is sad. Just read somewhere that the paedo who is very sick is willing to take a lie detector test. I find that very good. Maybe he could convince K & G to do the same? Fair, don't you think?

He must have been a very fit 62 year old to have lifted Madeleine out of her bed and carried her out of the window with his gloves on too, and only Kate's prints were found on the window.

As GA showed in his documentary, it would have been impossible for anyone to get out of that small space with a child, let alone an old man! However, some people will believe anything they read without giving any thought to it at all.

The man depicted by JT was in his late 30's with a shock of black hair and was moving quickly with the child. Not that I have ever believed made up story either!

Who will it be next?

I must have got the wrong idea from your post:

In fact in the UK and (clearly)in Portugal the police are indeed blamed for beating someone up, whoever it may be, charged and if proven, fired from the force. Nothing ass-like about the law in that respect imo.

Thin end of the wedge. If they get away with it, next time they beat up someone who perhaps has not deserved it. This was no 'slap'. I wouldn't like to be accused of something, be called to a police station and wonder if I'd still have my teeth when I left.

I'm not very PC but a line has to be drawn -- as we now see with our MPs. Remember that old Police song? 'Another one gone and another one gone and another one bites the dust'? It's been on my brain for days.

Sorry Claudia, Sky reported that Amaral was convicted of falsifying documents. I understand now it was for lying/perjury; they got it wrong.

If the court made a mistake and either or both are innocent I'm sure an appeal will succeed.

Absolutely Nancy, one can disagree about things without scratching people's eyes out. Hope you too are enjoying this wonderful weather.

Of course. That is why appeals exist. And in Portugal, a huge percentage of court cases go to appeal because rarely both parties are happy with the outcome. :-)

More diversion tactics from team McCann dont they realise the more they say the more their lies come undone???

Take Cooperman who now looks just like this suspect he was found a few day's after Clarrie did his dreadful presentation (cant stand the man but felt embaresed for him on that day he was hopeless)now they want to say this guy is him???

Jane Tanner saw a man with no face then sudenly every new discription was definatly the man she saw...

There is a 2 Million Reward on offer for information the wife of the dying peadophile has 6 chidren and is soon to be a widow she could make a fortune out of this if she wanted to say what Clarrie wants...

They should go very careful though because if they pass the buck to this man and get the confesion they want and if any money changes hands there is not a thing standing in the wife's way to sell her story of how she was paid off for her husband to take the wrap and if she can also prove where he was when Madeleine went missing I am sure the PJ will want to know why they had to fit someone up...

Here's hoping this re opens the case and Kate is asked back to answer those simple questions she could not be bothered to answer for Madeleine....

I hope you are right and all this ridiculous hype at least gets the Portuguese authorities to reopen the case.

Where does it say there is a £2m reward? I thought they said earlier they'd been advised that they didn't think that was a good idea I haven't seen that anywhere but if that's true, why the hell hasn't someone who has Madeleine or someone who knows someone who has Madeleine, come forward. I've always thought they should have advertised the reward every time they made a public appearance or put out new photos. Any parent would do that, especially after starting a fund presumably for the purpose of getting Maddie back!

The answer. in my opinion, is that no-one has Madeleine because, so very sad as it is, everything points to the poor child no longer being alive.

The Police should abide by the strict laws of judiciary of course but you must admit they have a tough job trying to get people to confess to anything these days with a lawyer sitting by the defendant's side telling him or her what to answer or what not to answer,and, in my opinion, being allowed to remain silent is the worst law that was ever brought in, apart from War situations when you only agree to give your name, rank and serial number.

Just how are the police supposed to glean information if a defendant is allowed to remain silent - they are working with their hands tied behind their backs, and all I'm saying is that they are human and I can imagine how frustrating it must be to have a laughing criminal in front of you knowing he is not going to co-operate at all.

I wouldn't want their job quite frankly.

As far as the Cipriano woman is concerned, beating her up was bestial but I can't find sympathy with her knowing what happened to poor Joana, can you?

On a lighter note, it's been a heavenly day, and still is, so I'm off for a walk with my other half very shortly! I just love the summer!

The tabloids are leading on the Hewlett story once again and complaining that the Portuguese authorities don't want to know and are insisting that Maddie is dead. Kate and Gerry are said to be furious at their non-co-peration! Touche Kate!!

That ghastly paedophile has a record of raping young pubescent girls not snatching children of 3 years old and carrying them away through narrow windows! What a waste of the Madeleine Fund, but then that's nothing new is it?

Sky News is reporting that Hewlett has denied any involvement in Maddie's disappearance.

I notice that all the media are giving prominence to the photo of Hewlett when he was probably in his 40's rather than how he would have looked a couple of years ago when Madeleine disappeared.

Talk about misleading information!
