Cipriano/McCann Case: Aragao Denyies He is Being Paid Just to Frame Gonçalo Amaral


"They've asked me to get in the Case"

The private detectives agency hired by the McCann couple asked Marcos Aragão Correia to enter in the 'Joana Case'. It is the lawyer, himself, who admits that Metodo3 ordered him to do 'an investigation' to the outlines regarding the [alleged] torture accusation of Joana's mother, by the PJ - the target, between the 5 inspectors, was evident: Gonçalo Amaral. Regardless, the [liar, pardon], the lawyer guarantees that now no one is paying him.

The private detective agency, contacted yesterday by CM, denied any connection whatsoever to the lawyer. The payment was also denied, even though Aragão Correia has already admitted that he received money to pay the 'expenses' when he made the searches to find Maddie's corpse in the dam of Bravura, in Lagos.

The lawyer from Madeira [Portuguese Island], told he had a supernatural indication to the whereabouts of the body of the British child and that he had gone to the Algarve at his own expenses. He entered in contact with the McCann Detectives, which made him a request: "They have asked me to try to get involved in the Case Joana to obtain statements from Leonor and her brother and to try to understand if there was torture, nothing else", he guarantees.

This at a time where suspicions have been raised that by defending Leonor, he is being paid by someone who is interested that Gonçalo Amaral is convicted, precisely because he was the Coordinator of the investigation to the Case Maddie, which pointed towards the involvement of the parents in the crime. "I don't get paid in pounds or in euros. I am here for principles, and my objective is to set free Leonor."

“We have beaten her up because nobody likes child murderers”

“The bruises on Leonor Cipriano’s face have not been inflicted by the (PJ) inspectors… she has been well watered in prison after she arrived, in prison nobody likes child murderers”, a former fellow inmate of Joana’s mother says, stressing that after that assault “Leonor was treated with special favour by the director”. The fellow inmate goes further and sustains that even after the aggression that she was the target of at the Prison of Odemira, there were never as many bruises on Leonor’s face or body, thus contradicting the veracity of the photos that were presented before the Court of Faro.

The revelations that were made to SMM, according this former inmate, are not new, but were not taken into account by the Polícia Judiciária: “when I realized what they were planning (Leonor and the director) I sent a letter to Faro, but I didn’t sign it, because I still had some time to do and I wanted no problems.”

After the alleged assault that she was victim of, Leonor has always stated that the former coordinator Gonçalo Amaral never touched her, but now, after the arrival of lawyer Marcos Aragão, she states the contrary, changing her version several times as the process evolves.

The director of Odemira prison “suggested” to a former chief of the prison guards that he should change the report that he wrote when Leonor Cipriano returned from the Polícia Judiciária in Faro with “red marks” on her face.

The revelation came as a surprise for everyone who yesterday watched the second session of the trial of five PJ elements who investigated the disappearance of Joana. The lawyer for four of the arguidos announced that he is filing a criminal complaint against Ana Maria Calado. “These are serious suspicions that have to be investigated”, António Pragal Colaço said when he was leaving the Court in Faro.

António Maia, who was heard as a witness, said that it was him who was on duty when Leonor returned to the prison on the 15th of October after the interrogation at the PJ that prompted the complaint which is now on trial. In the document, the prison guard wrote what Joana’s mother reported to him – that she fell off the stairs at the Judiciária in Faro due to “dizziness that she experienced because she had spent several hours without eating”. At that time, the prison’s director, Ana Maria Calado, was on vacation.

The revelation appeared when, after some vague replies like “I don’t remember” and “I can’t tell exactly”, the witness was being questioned by António Cabrita, Gonçalo Amaral’s lawyer. “After two weeks, when Leonor’s marks were much more visible, the director suggested that I should change the report in the part that referred to the dizziness”, he explained. A suggestion which the man, who now works at the prison in Silves, did not accept.

“Do you find this correct? Do you think that she fell down the stairs? Don’t you think that she was tortured?”, Ana Maria Calado asked him. “If you wanted to change the report, would she have given permission?”, the presiding judge asked. António Maia replied “yes”.

The prison guard further stated that he had been alerted to the “suicidal tendencies” of Joana’s mother, who was “under closer surveillance and protected by the director, who gave her cigarettes and spent hours with her in her office”. On one occasion, he referred, Leonor took out her shoelaces, which were immediately confiscated by a guard who feared that she might use them to hang herself.

The afternoon was further marked by a sudden remembrance. After stating that she could not remember who assaulted her during the first session [of the trial], Leonor delivered a piece of paper with the names of the five arguidos to the presiding judge yesterday. “The other day I was nervous, but a news piece came on tv with my husband (Leandro) saying that he saw Gonçalo Amaral beating and I remembered. The names of the others I took from documents that I have in prison”, she said, making the public that was completely filling the room burst into laughter.

“Was Dr Gonçalo Amaral in charge”; “Was Dr Gonçalo Amaral present?”; “Did Dr Gonçalo Amaral hit you?”. Gonçalo Amaral, Gonçalo Amaral, Gonçalo Amaral – this seems to be the obsession of Leonor Cipriano’s defense lawyer during the trial that opposes Joana’s mother to five Judiciária inspectors.


Three policemen stand accused of torture: Pereira Cristóvão, Leonel Marques and Paulo Marques Bom. But Leonor’s lawyer, Marcos Aragão Correia, has pointed his guns at Gonçalo Amaral, who in this process stands accused of false testimony and omission of denunciation.


“This doesn’t look like a trial in the Joana case but rather one in the Maddie case”, says a source that is connected to the defense of the former coordinator of the PJ in Portimão, who headed the investigations into the disappearance of both children and became a sort of “public enemy #1” for the McCann couple.


“A possible condemnation of Gonçalo Amaral in this process may make it easier for the English to prosecute the Portuguese state”, the source says.

They have paid the expenses

When confronted by 24Horas with the suspicions about his connection to the Maddie case, Marcos Aragão confirmed that he was already paid by persons that are connected to the McCanns. “They haven’t paid me honoraries but rather expenses due to transportation, lodging and food, in order to interview João Cipriano in prison”, the lawyer explained, adding that the purpose of the conversation was to “analyze” the procedures of Amaral as a PJ investigator.


Following the investigation – which originated a report from the Association Against Exclusion through Development (ACED) – Aragão Correia says that he accepted to represent Leonor Cipriano without charging one cent.


“I accepted this case for humanitarian reasons only. I am not receiving any honoraries”, the lawyer asserted, referring that the “attacks” against Gonçalo Amaral are linked to Leonor Cipriano’s strategy in this case: “It’s not an obsession. I can’t insist on the other arguidos because she has not identified them”.


Yesterday’s session at the Court in Faro was marked by a new contradiction from the plaintiff. On Monday, Leonor Cipriano had guaranteed that Gonçalo Amaral did not watch the questioning during which she allegedly suffered abuse in order to make her confess to her daughter’s death. Yesterday, Joana’s mother corrected her version: “Gonçalo Amaral beat me”. When questioned by the judge, she said she had recovered her memory after watching a report on television.

Missing Maddie McCann's furious parents have vowed to sue a lawyer who suggests they are guilty of child neglect.

Anthony Bennett, 61, is urging the Government to bring in a "Madeleine's Law" making it a criminal offence to leave children under 12 on their own.

His website attacks doctors Kate and Gerry McCann, both 41, over the disappearance of Maddie, now five, from their holiday flat in Portugal last year.

McCann spokesman Clarence Mitchell said: "Our lawyers are watching him. They are constantly monitoring his claims, which we consider are libellous."

A legal source close to the McCanns, of Rothley, Leics, said: "They are more than annoyed and deeply offended. They say enough is enough. All they are trying to do is get their daughter back."

Neglect

Neglect is the persistent lack of appropriate care of children, including love, stimulation, safety, nourishment, warmth, education and medical attention. It can have a serious effect on a child's physical, mental and emotional development. For babies and very young children, it can be life-threatening.

The signs of neglect

There are occasions when nearly all parents find it difficult to cope with the many demands of caring for children. But this does not mean that their children are being neglected. Neglect involves ongoing, severe failure to meet a child's needs. Here are some signs of possible neglect:

if the child seems underweight and is very small for their age
if they are poorly clothed, with inadequate protection from the weather
if they are often absent from school for no apparent reason
if they are regularly left alone, or in charge of younger brothers or sisters.

"A neighbour works full time and seems to be leaving her children alone during the day. Is this neglect?"

There is no UK law stating the age at which a child can be left at home alone. However, parents can be prosecuted for wilful neglect if they leave a child alone or unsupervised "in a manner likely to cause unnecessary suffering or injury to health" (Children and Young Persons Act 1933). Your neighbour may be having difficulties finding childcare. Perhaps the family is isolated and lacks the support of relatives and friends? As a neighbour, could you offer help with contacting local support services or with childcare? See People to talk to for organisations that offer childcare advice.

Babies should never be left alone, even for a short time. If you notice that a baby or a child under the age of nine has been left on their own, contact the police on 999. They will go to the house to make sure that the child is safe from harm.

Before leaving an older child alone, parents must take into account the child's age and maturity, their ability to cope in an emergency and how they feel about being left alone. Most children under the age of 13 are not mature enough to cope in an emergency and should not be left alone for more than a short time.

We recommend that children under the age of 16 should not be left alone overnight.

The register of entries and exits at the Faro Directory of the Polícia Judicária, which CM has had access to, reveals that the three inspectors who stand accused of torture over Leonor Cipriano, between 6 and 8 p.m. on the 14th of October 2004, were not inside the building during the period when Joana’s mother says she was beaten up.

The three of them arrived at precisely 8 p.m. – just like António Cardoso, who stands accused of falsifying a document. Concerning Gonçalo Amaral, who according to the Public Ministry failed to denounce the torture and gave a false testimony, he arrived at the PJ after 9.40 pm.

There was a clock on the wall of the room where Leonor Cipriano says she was beaten. When she was heard at Faro court on the 17th of October 2007, Leonor explained that the aggressions started between 5 and 6 pm and extended “over two hours, two hours and a bit”.

Leonor’s statements collide with the registry of entries and exits of the Faro Judiciária’s employees. According to that document, on the 14th, the seven inspectors from the major crime combat unit, including the three who stand accused, only arrived at 8 pm. All together.

The Public Ministry accuses Leonel Marques, Marques Bom and Pereira Cristóvão of torture, although the accusation dispatch refers that the aggressions were not inflicted by themselves, but rather by “unidentified individuals”. The accusation states that they acted “from a decision, following instructions and upon agreement” with the three arguidos, and that those “created conditions for the effect”.

The defense maintains that Leonor tried to throw herself down the stairwell at around 1 am. She was led to the Odemira Health Centre by the PJ on the following day, where she was assisted and then returned to prison. Before the supposed aggressions, on the 14th of October, Leonor had already confessed to killing her daughter.


Jurors’ vote equals judges’

The jurors that were chosen by Faro Court have a vote that is equal to those of each of the three judges, in order to decide if the accused inspectors should be condemned or acquitted. They are a taxi driver, a municipal fireman, a golf course receptionist and a finance technician, aged between 28 and 50. They started out as a group of one hundred, from where 18 persons were chosen. Ten were excluded by the inspectors’ lawyers, by Leonor’s lawyer and by the Public Ministry until only eight, four effective and four supplemental jurors, remained.

Carlos Anjos – The process started out upside down. It did not originate from a complaint by Joana’s mother. It originated from photographs that were published in a newspaper. There was almost an attempt to walk into this situation.

- Political intentions?

- It’s a recurrent theme, which is no longer justified. Above everything, I believe in my colleagues. They didn’t beat her. But there are people out there who promoted themselves to saviours of the homeland; someone who attained notoriety by making denunciations without proof.

- How do you see the participation of the Lawyers’ Bar as an assistant?

- There are approximately 200 processes where policemen complained of being aggressed. What I would like to know is if the Bar is going to become an assistant in said processes. I have never seen the Head of the Bar worried about the aggressions that victimize policemen. I have never seen the Bar defending policemen, or concerned about what happened to Joana or Maddie.


Directors on the witness stand

The joint national directors of the Polícia Judiciária (PJ), Guilhermino Encarnação (head of the Faro PJ) and Luís Neves (head of the Major Crime unit), are two out of more than 40 witnesses that were called to the stand by the defense of the five inspectors that are on trial.

These two high-ranking officials have already coordinated many cases in which the accused men were involved. And Santos Cabral, the PJ’s national director at the time, is going to witness in writing.
Among the witnesses, names like Marques Vidal, a jubilated judge and former general director of the PJ, Albano Pinto, a former joint national director of the PJ, and Orlando Romano, a public prosecutor and former national director of the PSP, stand out. The surprise factor was the call for João Grade, former lawyer for Leonor Cipriano, who decided to change her defense lawyer at the last minute.

A book by a Portuguese detective who investigated the disappearance of British toddler Madeleine McCann will be adapted for a television documentary, according to its producers.

Ex-detective Goncalo Amaral - who has sold 180,000 copies of "Maddie - The Truth of the Lie" - will narrate the documentary, which began filming this week in Algarve, the region where the girl went missing in May 2007.

"This documentary, currently being filmed, is based on the book by the former judicial police inspector," Cristina Valente, a manager in the Portuguese production company Valentim de Carvalho, told AFP.

Portuguese private television channel TVI has acquired the rights to the film.

In his 214-page book, Amaral repeats accusations of involvement by Maddie's parents, Kate and Gerry McCann, in their daughter's disappearance.

Amaral, who was sacked from the investigation in October 2007 for criticising British police, reiterates his belief that Maddie died in a "tragic accident" in the apartment in which she was sleeping the night she disappeared.

Portuguese authorities closed their investigation in July and lifted the "suspect" label from Maddie's parents due to lack of evidence.

Madeleine McCann went missing on May 3, 2007, days before her fourth birthday, from a holiday flat in the Portuguese resort of Praia da Luz as her parents dined at a nearby restaurant.

THE shamed cop who led the Madeleine McCann probe is cashing in AGAIN — with a TV film.

Parents Kate and Gerry were “disgusted” last night after ex-police chief Goncalo Amaral was seen with a camera crew at the Algarve apartment where the three-year-old vanished.

Portugal’s Channel 3 confirmed he was making a documentary for them — after already coining it with a book about the case earlier this year.

The McCanns’ spokesman Clarence Mitchell fumed: “He seems determined to make as much as he can out of Madeleine. He should be ashamed.”

Amaral was kicked off the case after accusing doctors Kate and Gerry, both 40, of killing Madeleine, of Rothley, Leics. (This part was just made up. He was not kicked off and the reason why he was told to leave the case had nothing to do with the suspicions regarding the main arguidos, at the time)

He repeated the slur in his book The Truth Of The Lie. The TV film will be screened on May 3 next year — the second anniversary of Maddie’s disappearance.

Mr Mitchell raged: “It’s beyond bad taste.”

A local in Praia da Luz, where Maddie vanished, said of the TV film: “It’s sick.”

Friends of Madeleine McCann's parents who were with the couple on the night she died are to receive £375,000 in libel damages, it has been reported.
Sky News said the money will be paid out to the so-called "Tapas Seven" by Express Newspapers.
The group were holidaying with Kate and Gerry McCann when three-year-old Madeleine disappeared in May last year.

Martin Brunt said: "The Tapas Seven, friends of Kate and Gerry McCann - those who were on hoiday with them in Portugal last year - are to receive apologies tomorrow morning in the High Court from Express Newspapers, and they will share a payout of £375,000.
"I'm told an apology will be read out in the court and then there'll be statements from the McCanns and the 'Tapas 7' lawyers.
"There will also be apologies in the Daily Express and Daily Star newspapers."
The newspaper group has already paid £550,000 dmanages to the McCann's after suggested they may have been involved in their daughter's disappearance.
The money is likely to go toward the Find Madeleine fund.

THE top criminologist in Portugal has slammed the investigation into the disappearance of Madeleine McCann.

Jose Manuel Anes said the methods used by police were flawed and out-dated.

He added: “Errors were made, not just by the Judicial Police, but by a whole group of people who took part in the investigations.”

Mr Anes, former head of criminology at Portuguese police’s science lab, attacked the decision to make Maddie’s parents Gerry and Kate “arguidos”, or suspects.

He said it was based on flawed evidence.

Mr Anes, 64, added: “There’s no knowing in what condition samples arrived at the laboratory.

“You find or you don’t find. You can’t invent! Also there’s a fundamental principle that it’s better to have a criminal free than an innocent in chains. That’s the slogan of our profession.”

Mr Anes also defended British police, arguing their offer of help was no impediment to Portuguese cops.

He said: “The English police even offered dogs. If they didn’t want to find anything, they wouldn’t have lent dogs.”

Mr Anes admitted the case has been an embarrassment to his country and that police did not handle the pressure.

Maddie vanished from a holiday apartment in Praia da Luz days before her fourth birthday in May 2007.

Her parents, of Rothley, Leics, were accused over the disappearance, but the case was dropped.

I got an e-mail reply from Mr Anes. He confirms he did not give any interviews in the past year (his only comments on the case are included in a interview published in a book called "A Culpa dos McCann" by Manuel Catarino) and that he is going to take legal action.

Amaral in Vigo: “In the Madeleine Case Politics Aborted the Police Investigation”


“I was attacked, defamed and humiliated by the ignoble British Press”, claims Gonçalo Amaral, the former coordinator of the Portuguese Judiciary Police.

That disappearance of a girl in the night of May 3, 2007 in the Portuguese Algarve while her English parents, the McCann, couple had dinner with several friends hundred meters away of the apartment in which she was sleeping with the brothers, was only that. A tragic disappearance like thousands that take place in the global geography and not even anything particularly unique for its dramaticism. Nevertheless, it turned into a universal and invasive phenomenon as an effect caused by the media. His book in Esquilo [Publishers in Spain], "Maddie, the truth of the lie ", clarifies the questions.

- Was this case blown out of proportion?

- It’s understandable that the parents turn to the media in cases like this one but we believe that in this occasion they have done it trying to create a sense of victimization to conceal what has happened. I agree with you that there are cases that are very much more tragic who are not so mediatised, that do not transcend to the entire world.

I see Gonçalo Amaral between smoke scrolls, a cigarette after another, forthright face and the eyes with a ‘broken glass’ look.

- They finished you off...

- Certainly, I was attacked, vilified and humiliated by some of the ignoble British press which contributed to the interruption of the investigation with their continuous onslaught and interrupted, therefore, the Justice. Portugal was treated like a Third World country and there is one thing where they [Translator's note here I assume some politicians, Justice Minister, Public Ministry, Attorney general & former PJ director] did behaved as such: when they removed me, the person responsible for the ongoing investigation. There were no police, but political reasons for this. The politics aborted the investigation.

- The fact is that his investigation was contradicting their interests.

Of course. The thesis of our latest work remained in the process and there it is summed up that the minor died in the apartment, there was a simulation of abduction, the couple is suspected of hiding the body, the death could have been accidental and that there is evidence of negligence in the care of the parents for leaving them alone even if they were one hundred meters away.

- Didn’t you rush yourselves in having them imputed [constituted as arguidos i.e. official suspects]?

How is it possible to speak about precipitation when we only accused them four months after the facts? On the contrary, we believe that one of the errors of the investigation was to have treated the couple “with tweezers”. Soon enough we saw that there were things that did not coincide and they were treated with privileges. They might have been imputed earlier...

"The citizen pays to have the right to safety"

Teams and special dogs for the search of living or dead Madeleine, hours, days and months of police work in the middle of a huge international media noise, vast numbers of followers or detractors... Can the public finances destine so much money to the investigation of every case? Amaral thinks that on Portuguese part there were no special expenses except the hiring of an English laboratory and the British police officers were paid by his country. "Nevertheless – he says - the criminal investigation has no price because the citizens pays taxes to have their safety".

- You worked for 28 years in the police. You have worked with cases enough to write a book of mystery...

- (smiles). True. For example, I had interesting cases of drug trafficking, some of which we worked with the Galician police, but those who have touched me most, emotionally, were some that included children. A father who killed his three-year-old son, for example, for jealousy. More tragic than the Maddie case although it has not been so mediatised.

- To what extent can the media interfere in the police work? ?

That is a very complex issue with many nuances. Our Judiciary Police has no press office to face the current challenges, nor an image consultant for its general director, or assistants that will examine what appears in the press or on the Internet. With this lack of resources it is not possible to answer to a British press that seems much more guided feeding information towards the thesis of the abduction and that influenced the investigation until the investigation stopped.
